Scrutinizing All Aspects Of Your Blood Test

Testing blood to determine blood alcohol content (BAC) level is a less common alternative to breath tests when a driver is suspected of being intoxicated. Many people view BAC results, whether they be from a blood test or breath test, as being such challenging evidence to try and overcome that they may not even explore all of their options.

Too many people fail to take the time and talk to a lawyer about what can be done to protect their rights after a DWI arrest. Many may feel that the results from a blood test is a strong piece of evidence and they need to take the prosecutor’s offer. But, with my skill and experience, I will work to be able to mount an effective defense against a DWI charge where a blood test was used to determine BAC.

Experienced DWI Defense

At the law office of James M. Wagman, Attorney at Law, I will look at the blood test itself for any possible way to counter that as a piece of evidence. I am attorney James Wagman, and I have been serving the needs of those who have been charged with DWI for more than 35 years.

I know that the chain of custody of the blood sample needs to be verified, and if there are any issues there the results of the test may be thrown out.

Some of the approaches to fighting a blood test BAC include:

  • Attacking the chain of command.
  • Attacking the accuracy of the results themselves.
  • Was the person who tested you adequately trained?

I will look at other means of protecting your rights in addition to attacking the results of the blood test itself, including:

  • Investigating whether there was probable cause to pull you over in the first place
  • Investigating whether any other medical factors could have influenced the results of your test
