What are the elements of drug cultivation charges?

Being in possession of an illegal drug or substance alone does not automatically mean that the accused will face other drug charges. However, if individuals in New York and elsewhere are found in possession of other items or equipment, then he or she could face additional allegations. Drug manufacturing and drug cultivation, for example, are considered serious charges and could carry harsh penalties. Thus, defendants should be aware of the elements necessary for prosecutors to obtain a conviction on these charges so that they can better defend against them.

Helping individuals make a defense against misdemeanor charges

While it is clear that serious criminal charges, like felonies, carry harsh penalties if a defendant is convicted, lesser chargers should be taken just as seriously. Much like a felony charge could impact the personal and professional lives of the accused, a misdemeanor charge could just as easily affect the life of a defendant if he or she is convicted. FBI report shows small increase in violent crime

As a previous post highlighted, convictions for gun crimes can carry serious penalties. Moreover, if a gun is used in the commission of a suspected crime, the accused could receive added years to their sentence if they are convicted of the underlying offense. Because crimes involving deadly weapons such as firearms could result in severe consequences, defendants in New York and elsewhere should understand the options available to them to try to reduce or avoid these penalties.
