Traffic stop leads to two arrested on drug charges

When law enforcement in Upstate New York makes a traffic stop, they will do so based on alleged traffic violation. While they investigate, they will also look at the driver and assess the situation to determine if the driver is under the influence or some other illegal behavior is taking place. If there are allegations of drug violations during a traffic stop, the person who is facing charges must know the importance of a strong defense and what options are available.

Two men were arrested on drug charges after their vehicle was stopped by law enforcement. The stop was made at around 9:30 p.m. When they investigated, the officers allege they smelled marijuana coming from the vehicle. They conducted a search and found marijuana and four grams of cocaine. The men, ages 21 and 22, were placed under arrest for a felony charge of fifth-degree criminal possession of a controlled substance. One of the men was charged with possession of marijuana.

When there are allegations of drug possession, the amount the person is said to have had will be an important factor in the severity of the charges. If the drug possession is believed to be linked to its sale, the charges will be harsher that if the person had a lesser amount.

Since drugs are treated as a significant problem in New York and across the nation, those who are charged with crimes related to it can be confronted with long-term consequences that can affect every aspect of their lives from taking away their freedom to large fines and being a blot on their record for the rest of their lives. If the charges were made during a traffic stop, calling into question the justification for the stop might be an effective defense. In some cases, the person might have a substance abuse issue and could benefit from a drug diversion program. No matter the situation, formulating a strong defense is imperative.

In this case, two men in their early twenties were arrested after a traffic stop when they were found to have possession of marijuana and cocaine. Considering that they are just starting out in their adult lives, they must make certain that they protect their interests by doing whatever possible to get a favorable outcome in their criminal case whether that is a plea bargain or an acquittal.
