Legal help is key for criminal traffic violations

On Behalf of | Dec 21, 2017 | Misdemeanors |

In New York, when people are confronted with traffic infractions, it might not seem serious. However, when these traffic violations become criminal issues, it can lead to major problems. Having an attorney who is experienced in helping clients facing criminal traffic charges is one of the most important factors in a successful resolution of a case.

For example, if a person is caught driving without a valid driver’s license, it is a crime. When a person is convicted for a felony traffic crime, there can be a variety of penalties, including jail, a fine up to $5,000 and the loss of the vehicle.

Simply losing one’s driver’s license can be problematic. Getting points on a driver’s license can result in revocation or suspension after 11 points in 18 months. With speeding, receiving three speeding citations within 18 months will result in the driver’s license being revoked for a minimum of six months. Driving between 1 and 10 miles over the speed limit will accrue three points. And, 11 to 20 mph over the limit will result in four points. In addition, 21 to 30 mph over the limit will be six points, and 40 mph or more over the limit will be 11 points.

For a person who has just gotten his or her driver’s license, two or more moving violations within the first six months in which the driver is on probation will result in a 60-day suspension. Speeding, reckless driving or other serious violations will also result in a 60-day suspension.

There are numerous ways in which a person can be charged with a criminal traffic violation. These include being in an accident and fleeing the scene, making it a hit-and-run. Depending on the circumstances, speeding can be a criminal act. When there is a crash and it leads to a death, the driver might be charged with either vehicular homicide or vehicular manslaughter. These are substantial charges and can result in harsh penalties like an extended jail sentence. People who might lose their freedom or their driving privileges due to criminal traffic violations must do whatever they can to combat the charges with help from a lawyer.
