Sometimes police arrest criminal suspects after a long investigation of the alleged crime. But sometimes they make an arrest on serious charges after investigating a seemingly trivial incident, such as a parking violation.
Such a situation recently occurred when a Jamestown man was stopped and arrested by New York police officers for drug charges and other criminal offenses. According to recent reports, officers approached the 34-year-old man while he was in his vehicle because he supposedly parked on the wrong side of the street at Prendergast Avenue and Crossman Street.
After confronting the driver, officers allegedly discovered a small quantity of heroin, a hypodermic instrument and marijuana in his possession. Police claim they also found a loaded 9mm handgun in the man’s vehicle that was allegedly located in an area where four young children present in his vehicle could easily reach it. They also allege that the gun was stolen.
The man was arrested and charged with second-degree criminal possession of a weapon, fourth-degree criminal possession of stolen property, seventh-degree criminal possession of a controlled substance, unlawful possession of marijuana, four counts of endangering the welfare of a child and parking on pavement.
A defendant facing drug crimes should understand the penalties associated with such crimes. Additionally, it important that defendants are aware of their legal and constitutional rights. Anyone accused of a crime is afforded the right to an attorney and the right to confront and cross-examine prosecution witnesses, which could help them reduce or even dismiss the charges against them.
