Combating Hand-Held Phone Violations

In February of 2011, New York revised the law governing hand-held phone and driving use. Now, in addition to receiving a distracted driving ticket, five points will be added to your license for using a hand-held phone while driving.

Too many points on your driver’s license may result in the loss of your license. Why take the risk? Contact the law office of James M. Wagman instead. I provide experienced traffic violation defense for drivers throughout most of New York state. I can help you fight distracted driving charges and avoid penalties.

Your License May Be At Risk

If you are driving with a phone in your hand, you can be ticketed for distracted driving. Hands-free phone use is now the only legal way to drive while using a phone. A driver caught using a hand-held phone for the following reasons will receive a ticket:

  • Talking
  • Texting
  • Emailing
  • Using the internet
  • Taking photos
  • Dialing
  • Playing games or music
  • GPS

In addition to the fine for a distracted driving ticket, you could end up paying higher auto insurance premiums. Having points added to your license can also be a problem. If you accumulate 11 points or more on your driver’s license within 18 months, you could lose your license.
