The Penalties For These Violations Can Be Severe

A New York driver’s license can be suspended by the Department of Motor Vehicles for several reasons, and if you are caught driving on a suspended license you can be ticketed for “aggravated unlicensed operation” also known as an AUO. License revocation carries more severe consequences; you lose your license. If your New York driver’s license is revoked, you must pay a relicensing fee and go through the process of applying for a new license after the revocation period is over.

What You Need To Know About The New York DMV Point System

One way to lose your license is by accumulating points for traffic violations. If you accumulate 11 points against your license within 18 months, the DMV will suspend your license. Points accumulate from the date of violation, not the date of conviction. Points for speeding violations range from three (1 to 10 mph over the limit) to 11 (40-plus mph over the limit.) Other point penalties include:

  • Five points — cellphone/electronic device
  • Five points — reckless driving
  • Five points — failure to stop for a school bus
  • Four points — inadequate brakes
  • Four points — driving too closely
  • Three points — failing to obey a traffic signal
  • Three points — failing to yield right-of-way
  • Three points — passenger safety violation, including seat belt and child safety
  • Three points — leaving the scene of an accident resulting in property damage
  • Three points — passing improperly, changing lanes unsafely
