A drunk driving conviction can have serious effects on a person’s life. People can face jail time, large fines, community service and probation if found guilty of a DWI. In addition to these penalties people may also lose their drivers’ licenses or be forces to use an ignition interlock device in their car. These penalties can affect a person’s financial future, limit job opportunities and more.
Furthermore, a drunk driving conviction stays on a person’s record. This means that if a person is accused of DUI in the future the penalties for the subsequent DWI can be increased.
Recently, a New York man was arrested for supposedly driving while intoxicated. He has been charged with felony DWI since he has a previous drunk driving conviction on his criminal record. In this case, the man was stopped by Buffalo, New York police while driving alone in his car.
According to police, they could smell alcohol and marijuana coming from the car during the stop. As a result, the police searched the man’s car. In the search, police claim to have found narcotic pills, marijuana residue, marijuana and pipes for smoking. Police allege that the man had a blood alcohol content level of 0.15 percent and failed field sobriety tests.
In addition to the DWI, the man has also been charged with speeding, drug charges and felony aggravated unlicensed operation.
When New Yorkers are facing drunk driving charges they need to be aware of their constitutional rights. Police have certain procedures that they must follow when stopping people, conducting tests, searching vehicles and more. If these procedures are not followed that police evidence could be excluded from court. Challenging police evidence is just one way to combat DWI charges so that people do not face harsh penalties now, and even harsher penalties in the future.
