Technology outpaces many laws

Technology is developing at a pace that is hard to keep up with. With that rapid development, it is not always clear how laws in New York State or elsewhere in the nation will be applied. A case developing in another state highlights the difficulties that could be encountered when current laws are not designed to address new technology. The case, occurring in California, involved Google Glass, the wearable computer that is currently in development by Google.

The facts of the case are as follows. The woman was wearing the glasses when she was pulled over outside of Los Angeles for suspicion of speeding. She was also cited for driving with a video or TV in the car. She said though she was wearing the glasses while driving, they were not on. The movement she made with her head when she looked up at the officer who pulled her over, turned them on.

While several states are currently drafting laws regarding Google Glass, the case poses multiple questions for others, including:

  • Should Google Glass be considered a hands-free accessory?
  • Should wearable tech be banned?
  • Do distracted driving laws apply to Google Glass?
  • If Google Glass is covered by distracted driving laws, are they applicable when the device is not on?

The woman and her lawyer assert that Google Glass should not be subject to the citation regarding driving with a video screen on. How the case will be resolved remains to be seen.

Traffic stops can be more than just a nuisance. This is particularly true when, as was the case in this instance, additional citations are added. In these situations, it is likely that the accused could benefit from working with a lawyer who handles traffic violation cases.
